The fiscal leadership supports filing the complaint by Ayuso’s partner against two colleagues for revealing secrets

After an extensive meeting, the Board of Court Prosecutors has endorsed the criteria of the lieutenant prosecutor of the Supreme Court, María Ángeles Sánchez Conde, of reject the couple’s complaint Isabel Diaz Ayuso against the provincial chief prosecutor of Madrid and another colleague from the Public Ministry. This concluded the meeting in which 32 prosecutors participated and which lasted more than five hours. The prosecutor in charge of ruling on the complaint, María de la O Silva, saw a possible crime in the actions of her colleagues and was in favor of carrying out proceedings, but García Ortiz’s number two was opposed.

Silva invoked article 27 of the Organic Statute of the Public Prosecutor’s Office, provided for cases in which an inferior disagrees with the criteria of his superior, thus calling a meeting of the Board of Court Prosecutors. The decision that was taken from the Board, in any case, It was not binding for Sánchez Conde. The partner of the president of the Community of Madrid, Alberto González Amador, denounced the chief prosecutor of Madrid, Pilar Rodríguez, and the economic crimes prosecutor Julián Salto for an alleged crime of revealing secrets.

On March 14, the Madrid Prosecutor’s Office issued a press release about the exchange of messages with González Amador’s defense. Previously, information had been published about an alleged offer that the Public Ministry had transferred to him and then retracted.

As clarified in the press release by the Prosecutor’s Office, it was González Amador’s lawyer who had sent an email to the Madrid Prosecutor’s Office acknowledging the commission of two crimes and requesting a financial agreement. From there arose the complaint filed by González Amador, who appreciates a possible crime of revealing secrets in the actions of the two prosecutors.

Silva, in charge of informing the Superior Court of Justice of Madrid of the position of the Prosecutor’s Office on the complaint, considered that there was a possible crime and It was necessary to investigate the communications between the defense of Ayuso’s partner and the Prosecutor’s Office. But the lieutenant prosecutor, Sánchez Conde, was in favor of filing the complaint. She alleged that a complaint filed by the Madrid Bar Association (ICAM) in relation to the same events had already been filed.

The Board of Court Prosecutors, the advisory body invoked by Silva, met at 9:30 a.m. to take part in the confrontation, although Sánchez Conde would always have had the last word. According to tax sources, prosecutors Antonio Vercher, Elvira Tejada, Alejandro Luzón and Jesús Tirado have abstained from attending the meeting, with 32 prosecutors attending. At 6:00 p.m. the Board’s support for Sánchez Conde’s criteria was confirmed. “There is no crime nor are there any indications against the defendants,” Sources from the Prosecutor’s Office have explained.

As reported by Ep, The lieutenant prosecutor of the Supreme Court has been the first person to intervene and has defended the file of González Amador’s complaint. He recalled that the Public Prosecutor’s Office already adopted this criterion with the ICAM complaint on April 9 and has advocated maintaining unity of criteria in this regard. At that time, the Madrid Prosecutor’s Office defended the “constitutional legitimacy” of the press release, whose objective was to address “untrue information.” Prosecutor María de la O Silva herself took the floor next and explained her position before the rest of the prosecutors continued from junior to senior.
