The maximum amount that the Treasury can return in the income tax return

As the period to present the statement of incometaxpayers who face this procedure may find themselves in three situations: the declaration is to pay, that it comes out zero, or that it comes out negative, that is, the Treasury must return an amount of money to the taxpayer, since it has withheld more than it should have throughout the year. In the latter case, the return period may be extended until December 31, 2024.

In this sense, the Tax agency expects to receive a total of 23.3 million declarations for this campaign, the majority (14.6 million) to return, for a total amount of 11,650 million euros. However, the amount that the Treasury returns to taxpayers is not always the same: is there a maximum limit of money to be returned?

In general terms, there is no maximum limit amount set by the Tax Agency, but this body is governed by the regulations when it comes to returning money to taxpayers.

Specifically, the article 103 of the Personal Income Tax Law states that the amount to be returned by the Treasury is equivalent to what has been overpaid during the previous financial year, that is, when the sum of withholdings, deposits on account and installment payments is greater than the amount of the installment resulting from the self-assessment. For this reason, the Treasury cannot return more money than has been advanced in the fiscal year, they remember from News Work.

In this way, if when filing the Income Tax return the balance comes out negative, this means that the Tax Agency must return that amount to the taxpayer. In this case, it is not necessary to carry out any additional procedure, although it is mandatory to indicate the bank account in which this income will be received from the Treasury.

The 2023 income campaign It started last April 3 for the presentation of returns online, both through the Income Web program and the Tax Agency’s mobile application. From May 7th The service is also opened to file returns by phone through the program ‘We will call you’for which the taxpayer requests an appointment and, on the agreed day, the Tax Agency calls him to prepare the declaration.

The via telephone has been gaining weight in recent years – more than a million taxpayers used it in the 2022 campaign – and it is complemented by the in-person one in offices, which will start on June 3, with an appointment that can be requested from May 29.
