The Cierco want to remove the Government from the case against them for discrediting the institutions and money laundering

Andorra la VellaIn the context of the case against the Higini brothers and Ramon Cierco Noguer, among others, for alleged crimes of illicit association and money or securities laundering and minor against the prestige of the institutions, the Constitutional Court has ratified that the Government can take part. The ex-owners of BPA opposed this fact and did not agree with the decision of the TC to allow the continuity of the executive. For this reason, they presented an appeal to the same court.

The Ciercos already assumed that the appeal would have no effect and they acknowledge in their letter that “as they have no new elements of fact or law, they formulate this appeal exclusively for the purpose of being able to have access to the European Court of Human Rights”. To be able to present an appeal in Strasbourg, it is mandatory to have exhausted all the judicial instances in the country of origin. And the appeal to the Constitutional Court is the last within Andorran Justice.

In the letter, they even urged that as “the object of the appeal is to comply with the requirement of the exhaustion of internal avenues of appeal, there is no need, therefore, for the Constitutional Court to rule on this appeal plea that diverts the object of this appeal”. The Constitutional Court is not pronounced, as requested by the ex-owners of BPA, and the continuity or not of the Government in the case against the Cierco brothers is now only pending before the Human Rights Court of Strasbourg.
