The State Attorney General, Alvaro Garcia Ortizconsider that The Third Chamber of the Supreme Court (TS) has “now” changed its jurisprudence introducing “other criteria other than those specifically established by the statute” after annulling this Tuesday the appointment of Dolores Delgado as prosecutor of Democratic Memory, after last November the same court appreciated “deviation of power” on her part in the previous appointment of her predecessor as a robed prosecutor.
In his opinion, the requirement of the Third Chamber regarding the appointments of the attorney general “has risen to the legal dispute”. “Practically the attorney general could appoint the person he considered most suitable and most convenient because the legal requirements were there,” he said in an interview in TVE.
Of course, GarcÃa Ortiz has pointed out that the TS sentence will be executedit will be assumed and what it means will be read, although predictably, he predicted, we will have to “return to the place of origin”, that is, at the beginning of the Fiscal Council to “examine whether this incompatibility exists or not.”
In this sense, the attorney general has defended his position on the appointment of Delgado to the position, ensuring that he made this decision since the “incompatibility was so obvious that it did not exist”. As she later said, bringing it up to the Fiscal Council “was nothing more than a delaying tactic” to prevent her from being appointed to the legislature. “That is the basis of all discussion,” she has argued.
