Sentenced to 15 years for trying to kill a couple over a bad neighborly relationship

The Hearing of Girona has condemned 15 years in prison to the resident of Sant Feliu de Guíxols (Girona) who, on January 30, 2022, in the middle of the street and in broad daylight, tried to stab to death a couple of neighbors with whom he had a bad neighborly relationship.

The Prosecutor’s Office accused the defendant of two crimes of attempted murder with the analogous mitigating circumstance of mental anomaly and requested a sentence of 11 years and three months in prison for each of the crimes.

The sentence of the third section of the Court of Girona, of which judge Manolo Marcello was the speaker, condemns him to 15 years in prisonseven and a half years for each crime, imposes 10 years of supervised release and prohibits him from approaching less than 500 meters from the victims during the same years.

As a matter of civil liability, the accused is sentenced to compensate victims with more than 41,000 euros each and must also compensate the Institut Català de la Salut with 11,737 euros.

The Chamber considers it proven that the accused and the victims, of Spanish nationality, were neighbors and they had had a bad relationship for some time, and that, at noon on January 30, 2022, the couple went to have a vermouth at a bar near their house, something they usually did and of which the accused was aware.

The defendant, according to the sentence, waited for the couple hidden, so that neither his neighbors nor other people could see him, with two knivesone of 12.8 centimeters and another of 12, and when his neighbors returned to their house, by surprise, he pounced on them.

As a result of the attack, the woman received at least five stabs, he had to spend three days in intensive care and five in the ward, and he has been left with several scars, an anxious-depressive disorder and another neurotic disorder derived from severe post-traumatic stress. The man suffered at least seven injuries and also had to be taken to a hospital, where he remained for three days.

The ruling recalls that the forensics were “very illustrative” noting that the wounds suffered by the victims “located at the abdominal and thoracic level are very life-threatening.”

The ruling considers the accused’s version is contradictorywho assured that he went out to the street to solve problems with his neighbors and that they were the ones who pounced on him and hit him.
