A group of retired jurists has filed a complaint with the Supreme Court against the emeritus king Juan Carlos I for alleged fraud in its tax regularization. Among the promoters of this complaint are the former Supreme Court justices José Antonio MartÃn PallÃn and Clemente Auger, as well as the former anti-corruption prosecutors Carlos Jiménez Villarejo and José MarÃa Mena, all of them already retired. Intellectuals such as philosophers Josep Ramoneda and Santiago Alba, or José Saramago’s widow, Pilar Sánchez, also sign the complaint.
The plaintiffs, who act as the popular prosecution, filed the complaint this Sunday and denounce that the tax regularization carried out by Juan Carlos I, corresponding to the years between 2014 and 2018was not done in accordance with the law because the emeritus was previously informed by the Prosecutor’s Office that an investigation had already been opened.
According to the promoters of the complaint, the legislation prohibits a tax regularization from being carried out when the Tax Agency or the Prosecutor’s Office They have already started an investigation. In addition, the former magistrates explain that five alleged tax crimes committed by the king emeritus between 2014 and 2018 would not have prescribed because they are aggravated.
“When the Public Prosecutor’s Office informs an investigated party of the opening of an Investigation Procedure in which there is data on irregular activities with tax relevance, it can never have detailed knowledge of the data that supports a possible tax violation because it is information of which only the Tax Agency can be aware once the sanctioning file is concluded, which closes the way to the possibility of regularization,” the text reads.
Likewise, they ask that a statement be taken from Juan Carlos I in Abu Dhabi, where the monarch currently has his residence.
