The prosecutor requests to dismiss the case against Trump for the assault on the Capitol

Special prosecutor Jack Smith requested this Monday dismiss the case against the next president of the United States, donald trumpfor the assault on the Capitol before he assumed power. In a court brief, Smith noted that Trump won the Nov. 5 election and that internal Justice Department policy prohibits him from pursuing criminal charges against a sitting president.

After consulting with the Office of General Counsel, Smith concluded that “the indictment must be dismissed before the defendant takes possession“. The judge handling the case, Tanya Chutkan, of the federal court of the District of Columbia, granted a pause to the case on November 8 after the prosecutor requested it to have time to analyze the consequences of the result electoral. The president-elect is accused of four federal charges.

The Republican said during the campaign that on his first day as president he would fire Smith and would order the Department of Justice close the cases against you. According to the president-elect, they were motivated by political persecution.
